Scope of provided services
Jom Classifieds software comes with technical support for the period of the membership a user subscribe for. Further the support is limited to the number of domains mentioned in the respective membership plan. For support purpose, a single installation of Joomla® is treated as one domain.
No warranty
The Jom Classifieds extension in the hope that it will be useful, but WITHOUT ANY WARRANTY; without even the implied warranty of MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE. User generated content
JomClassifieds users may post, upload and/or contribute (“post”) content to the Service, including pictures, text and playlist compilations (“User Content”). You represent that you have the right to post any User Content which you post to the Service, and that such User Content, or its use by us as contemplated by this Agreement, does not violate these Agreements, applicable law, or the intellectual property rights of others. You grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any User Content that you post on or in connection with JomClassifieds. This license lasts until you terminate your JomClassifieds account, except in the case of User Content that you have published, made public and/or share with others. Aside from the rights specifically granted herein, you retain ownership of all rights, including intellectual property rights, in the User Content that you post to the JomClassifieds Service, except that, where applicable under Local Country law, you agree to waive your right to be identified as the author of any User Content on the JomClassifieds Service and your right to object to derogatory treatment of such User Content.
JomClassifieds does not monitor, review, or edit User Content, but reserves the right to remove or disable access to any User Content for any or no reason, including but not limited to, User Content that, in JomClassifieds’s sole discretion, violates these Agreements. JomClassifieds may take these actions without prior notification to you. Removal or disabling of access to User Content shall be at our sole discretion, and we do not promise to remove or disable access to any specific User Content.
JomClassifieds is not responsible for User Content nor does it endorse any opinion contained in User Content. User Guidelines
We’ve established a few ground rules for you to follow when using the Service, to make sure JomClassifieds stays enjoyable for everyone. Please follow these rules and encourage other users to do the same.
JomClassifieds respects intellectual property rights and expects you to do the same. This means, for example, that the following is not permitted: (a) Copying, reproducing, “ripping”, recording, or making available to the public any part of the JomClassifieds Services or content delivered to you via the JomClassifieds Services, or otherwise any making use of the JomClassifieds Service which is not expressly permitted under these Terms; (b) using the JomClassifieds service to import or copy any local files you do not have the legal right to import or copy in this way; (c) reverse-engineering, decompiling, disassembling, modification or creating derivative works based on the JomClassifieds Services or any part thereof; (d) circumventing any technology used by JomClassifieds, its licensors, or any third party to protect content accessible through the Service; (e) renting or leasing of any part of the Services; (f) circumventing of any territorial restrictions applied by JomClassifieds; (g) artificially increasing play count or otherwise manipulating the Services by using a script or other automated process; (h) removing or altering any copyright, trademark or other intellectual property notices contained on or provided through the JomClassifieds Service; (i) providing your password to any other person or using any other person’s user name and password.
Please respect JomClassifieds and other users of the JomClassifieds Service. Don’t engage in any activity on the Service or upload User Content, including registering and/or using a username, which is or includes material that (a) is offensive, abusive, defamatory, pornographic or obscene; (b) is illegal, or intended to promote or commit an illegal act of any kind, including but not limited to, violations of intellectual property rights, privacy rights or proprietary rights of JomClassifieds or a third party; (c) includes personal data of third parties or is intended to solicit such personal data, (d) includes malicious content such as malware, trojan horses or viruses, or otherwise interferes with any user’s access to the Service; (e) is intended or does harass or bully other users; (f) impersonates or misrepresents your affiliation with another user, person or entity, or is otherwise fraudulent, false, deceptive, or misleading; (g) uses automated means to artificially promote content; (h) involves the transmission of unsolicited mass mailing (“spam”), junk mail, chain letter, or similar, including through the JomClassifieds inbox; (i) involves commercial or sales activities, such as advertising, contests, sweepstakes, or pyramid schemes; (j) promotes commercial products or services; (k) interferes with the JomClassifieds Service, tampers with or attempts to probe, scan, or test for vulnerabilities in the Service or JomClassifieds’s computer systems or network, or breaches any of JomClassifieds’s security or authentication measures, or (l) conflicts with the Agreement, as determined by JomClassifieds. You agree that JomClassifieds may also reclaim your username for any reason.
Please be thoughtful about what you make public on JomClassifieds. The JomClassifieds Service includes social and interactive features, including the ability to post User Content, share content, and make certain information about you public, as further described in your account settings. Remember that shared or publicly available information may be used and re-shared by other users on JomClassifieds or across the web, so please use JomClassifieds carefully and manage your account settings regularly. JomClassifieds has no responsibility for your choices to make any actions or material public on the Service.
Your password protects your user account, and you are solely responsible for keeping your password confidential and secure. You understand that you are responsible for all use of your username and password on the Service. If your username or password is lost or stolen, or if you believe there has been unauthorized access to your account by third parties, please notify us immediately and change your password as soon as possible.
Refund policy
demo.jomclassifieds.com provides the fully functional demo of the software for you to evaluate. If you are unsure of the software fits your needs, please do contact us before purchasing.
On the following conditions you may be eligible for refund.
- You bought a wrong subscription, however not yet downloaded the software. Since we do not have any control over the software after it is downloaded, we treat the software is being used after it is downloaded. Please do contact us for any membership switch overs before you download the software.
- Issues related to hosting/installation which we could not fix and the software cannot be used on your website. We do not support the localhost websites and the sites which we do not have access to.
- Charged multiple times for the same subscription
Support policy
We only provide support to our subscribers through our site's Forum Section and Email. We will not provide support by any other means including, but not limited to, email, regular mail, telephone, Twitter, Facebook, Skype and so on.
Subscription at jomclassifieds.com are not to be considered as a gurantee of response time or a service level agreement. All support requests are answered on a "best effort" basis. If we determine that there is an objective difficulty in providing support to you over our forum section we will provide you with support over email, in exception of our support policy.
We reserve the right to provide no support for outdated versions of our software or when your server environment does not meet our minimum requirements. Support policy details regarding different versions of our software and server environment are detailed in our release announcements. We reserve the right to give you a link to our troubleshooting page, documentation and/or previous support topics if we deem it necessary for providing better support. We will not provide support for issues not related to our software or services. We reserve the right to decline support if the request or the conversation is conducted in a language other than English or when the language barrier makes it impossible to provide meaningful support. We reserve the right to decline support when access to the affected site is denied or objectively impossible. We reserve the right to decline providing support on a case by case basis (even though we do try to help everyone), with or without a reply to your support request. We assume no responsibility for any issues directly or indirectly caused by our support efforts, as per the "No warrantly" article of this policy. We reserve the right to close support topics for any reason deemed appropriate. We reserve the right to decline providing support for issues which have to do with using Joomla!, not our software (e.g. Joomla! ACLs). We reserve the right to close or delete forum/support topics if the user refuses to follow our instructions and insists on receiving support (our instructions are support and you're supposed to follow them in order for us to help you). We reserve the right to edit or delete topics or topic replies. We reserve the right to close or delete topics and/or block accounts of users who become abusive and/or pugnacious in their support replies; we are trying to help frustrated users under adverse conditions, please respect it and understand that we are neither deities nor saints.
Fair use policy
The owners of Jom Classifieds believe in software Freedom and strive to provide low cost, high quality services surrounding their software. In order to keep the costs low, without placing artificial restrictions, we have a fair use policy in place. In no event shall we provide support to anyone who is seeking our support for more than domains supported by the respective membership. This restriction is in place to deter edge cases, like a hosting provider buying a single subscription, installing the software on all of his clients' sites and then overflowing our support services with its client's requests. If such behaviour is detected, we regret to inform you that we will immediately terminate the user account without a refund.
Moreover, jomclassifieds.com reserves the right to terminate any account which is supected in being implicated in unlawful or abusive activity, including –but not limited to– unsolicited mass distribution of our for-a-fee software. Account termination is in the sole discretion of jomclassifieds.com and we reserve the right to not provide any prior warning or further information.
Actions for content beyond fair use and account termination policy
If the content you submit to jomclassifieds.com is deemed offensive, inappropriate, defamatory, objectionable or in any other way engage in disruptive behavior we reserve the right to use your personal information to stop such behavior.
If jomclassifieds.com believes on reasonable grounds that you are in violation of the laws of India, we reserve the right to submit your personal information - including the content itself and any other relevant information about you - to the proper authorities.
jomclassifieds.com reserves the right to terminate user accounts (free or paid subscribers) when the aforementioned fair use rules are violated. Furthermore, jomclassifieds.com reserves the right to terminate user accounts if the user is posting unsolicited messages (spam), engaged in sites or services promoting the unauthorized distribution of proprietary or other distributed for-a-fee software, directly promoting or linking to resources promoting indecent or unlawful actions, or in any other way trying to disrupt or diminish the quality of the services offered by this site. Account termination takes place without prior notice and is considered final. Holders of terminated accounts, if they are paid subscribers, will not be refunded. jomclassifieds.com reserves the right to terminate any further user accounts created by the holder of a terminated account, or any other person, business or organization affiliated with or endorsed by the holder of a terminated account.
Zero spam tolerance
As noted above, if you send out an unsolicited message, your account will be terminated without prior notice. One strike and you're out. Moreover, you will feed our anti-spam filter with keywords so that you can't spam us again.
Zero bandits tolerance
If you do as much as imply that you are encouraging people to use illegal or unofficial copies of software your account will be terminated without prior notice, as noted above. Respect the work of others and we'll respect you. If you don't and act as a bandit, you'll be treated as one.
Updates to our ToS and Privacy Policy
We reserve the right to add, remove or modify any section, article or paragraph of our Terms of Service and Privacy Policy without prior notice. All changes are effective immediately.
